Executive order no. 4 of 23 September 2009 from the Faroese Maritime Authority on passenger lifts (lifts) on board ships

Pursuant to section 2 subsection 2, section 6 subsection 3, section 18 subsection 3 and section 49 subsection 2 and 3 of the Parliamentary Act no. 165 of 21 December 2001 on safety at sea with later amendments, and in consultation with the Minister,the following shall be laid down:

Section 1. The technical provisions in “the Danish Maritime Authority’s Technical Regulation no. 4 of 15 November 2005 on passenger lifts on board ships” (Order no. 9830 of 1511.2005) shall hereby enter into force on the Faroe Islands and shall be reproduced in annex to this executive order from the Faroese Maritime Authority.

Section 2.The provisions in the annex shall be read, understood and interpreted with regard to below mentioned adjustments to Faroese conditions:

  1. Everywhere where “the Danish Maritime Authority” is stated as authority, it shall be understood as “the Faroese Maritime Authority”
  2. In general, all provisions shall be read and understood with regard to Faroese vessels, Faroese conditions and Faroese jurisdiction
  3. The guidelines in force at any time from the Danish Maritime Authority, and which relate to this executive order, shall also with necessary adjustments be applicable for the Faroese Maritime Authority

Section 3.Contraventions of this executive order from the Faroese Maritime Authority shall be liable to punishment by fine, simple detention or imprisonment for a term not exceeding 2 year.

Subsection 2.Companies, etc. (legal persons) may incur criminal liability according to the regulations in chapter 5 of the Faroese penal code.

Section 4. This executive order from the Faroese Maritime Authority shall enter into force on 1 November 2009.

Subsection 2.At the same time “Technical Regulation no. 7 of 3 July 1997 from the Danish Maritime Authority on passenger lifts on board ships” is made void.

Annex to Executive order no. 4/2009 from the Faroese Maritime Authority

Technical Regulation on passenger lifts on board ships

Application

Section 1. This regulationshall apply to passenger lifts in all ships with a gross tonnage of 20 and above, with the exemption of section 3, which only applies to ships the keels of which are laid or which were at a similar stage of construction on or after 1 November 1997.

Definition

Section 2. For the purpose of this regulation,”Passenger lift” shall mean: permanently installed lifting apparatus for the carriage of persons and/or goods between fixed levels by means of a car (cabin) , the dimensions and design of which clearly allow access of persons.

Construction, installation and initial survey

Section 3. The construction and installation of passenger lifts shall be carried out in accordance with ISO-8383, and DS/EN 81-1, and the regulations for lifts of an approved organisation.

Subsection 2.When constructing and installing lifts in passenger ships, consideration shall be made to ensure the safe access for persons with reduced mobility as stated in Notice from the Danish Maritime Authority B, Chapter B II-3, regulation 30, and Notice from the Danish Maritime Authority D, Chapter D II-3, regulation 28.

Subsection 3. Documentation stating that the above provisions have been complied with shall be sent to the Danish Maritime Authority, and new installations shall be surveyed by the Danish Maritime Authority before being put into service, whereupona certificate of approval shall be issued.

Subsection 4.The Danish Maritime Authority may authorise undertakings or individuals to partly or wholly carry out surveys in connection with putting into service and the issuing of an approval certificate.

Subsection 5.The certificate of approval shall be displayed in the liftcar.

Annual renewal surveysand checks, etc.

Section 4. An annual renewalsurveyshall be carried out on passenger lifts and their fittings in accordance with the requirements of ISO-8383 and DS/EN 81-1 concerning regular surveys and test. A survey report shall be drawn up and shall be kept on board.

Subsection 2.Following a satisfactory renewal survey, a certificate of approval shall be issued. The certificate of approval shall be issued by theperson who has surveyed the lift.

Subsection 3.The certificate of approval shall be displayed in the liftcar.

Section 5. In addition, a check of passenger lifts and their fittings shall be carried out once a month in accordance with the manufacturer’s instructions.

Section 6. The Danish Maritime Authority may permit the required renewal surveys and checks to be carried out by the ship’s chief engineer, engineers or electricians on the condition that the person who carries out the survey or check has attended a course approved by the Danish Maritime Authority on the maintenance and survey of lifts.

Subsection 2. The Danish Maritime Authority may authorise undertakings or individuals to carry out the required renewal surveysand checks.

Equivalents and testing

Section 7.The provisions of this regulation shall not prevent the use on board of other equipment, materials, arrangements, apparatus, etc. or the implementation of other measures which provide at least the same degree of safety as stipulated in this regulation.

Subsection 2.The Danish Maritime Authority shall accept tests that have been carried out by approved testing bodies, including testing bodies in other EU member states as well as in countries signatory to the EEA Agreement as well as in Turkey, and which provide appropriate and satisfactory guarantees of the technical, professional and independent nature of the tests.
